1. Introduction

These Purchase Terms and Conditions (“Terms”) form a legally binding agreement between Equine Sport (“we”, “us”, or “our”) and the purchaser (“you” or “the customer”). By placing an order through our website, you confirm that you have read, understood, and agreed to be bound by these Terms.


2. Eligibility to Purchase

By making a purchase, you confirm that:

  • You are at least 18 years old and legally capable of entering into a binding contract.
  • All information you provide is truthful and accurate.
  • You are purchasing for personal or lawful business use only, and not for unauthorized resale.


3. Product Descriptions and Availability

We make every reasonable effort to ensure that product descriptions, prices, and availability are accurate. However:

  • We reserve the right to modify or discontinue any product at any time without notice.
  • All images are for illustrative purposes and may differ slightly from the actual product.
  • We do not warrant that product descriptions or other content are error-free or complete.


4. Pricing and Payment

  • All prices are listed in South African Rand (ZAR) and include VAT unless explicitly stated otherwise.
  • Full payment is required at checkout. Orders will not be processed until payment is confirmed.
  • We accept payments via EFT, credit/debit cards.
  • We reserve the right to cancel any orders resulting from pricing or typographical errors.


5. Order Acceptance and Contract Formation

  • Your order constitutes an offer to purchase goods from us.
  • Acceptance occurs only when you receive a formal order confirmation from us.
  • We reserve the right to refuse or cancel any order at our sole discretion, including for suspected fraud, misuse, or breach of these Terms.


6. Shipping and Delivery

  • Delivery is available within South Africa. Shipping costs and estimated delivery times will be disclosed at checkout.
  • All delivery dates are approximate. Delays caused by courier services, weather, or customs are beyond our control and do not constitute grounds for cancellation or refund.
  • Risk of loss passes to you upon delivery. It is your responsibility to inspect the package and report any damages or discrepancies within 48 hours of receipt.


7. Ownership and Title

Title to goods transfers to you only after full payment has been received and goods have been dispatched. Until such time, all goods remain the property of Equine Sport.


8. Returns, Exchanges & Cancellations

Returns and exchanges are subject to our Returns and Exchange Policy, which forms part of these Terms. We reserve the right to decline returns or exchanges that do not comply with our stated conditions.


9. Warranties and Defective Products

  • Products may be covered under a manufacturer’s warranty where applicable.
  • You must notify us of any defect within 7 days of delivery and provide sufficient evidence (photos, order number, etc.).
  • We reserve the right to repair, replace, or refund the defective product at our discretion.


10. Limitation of Liability

To the fullest extent permitted by South African law:

  • We are not liable for any indirect, incidental, special, punitive, or consequential damages.
  • Our total liability shall not exceed the amount paid by you for the relevant product(s).
  • We shall not be liable for loss or damage caused by improper use of products, user negligence, or failure to follow usage instructions.


11. Force Majeure

We are not responsible for any failure or delay in performing our obligations due to events beyond our control, including but not limited to natural disasters, war, pandemics, strikes, or interruptions in transportation or utility services.


12. Dispute Resolution and Governing Law

  • These Terms shall be governed by the laws of the Republic of South Africa.
  • Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Port Elizabeth, South Africa.
  • We reserve the right to seek injunctive or equitable relief in any competent jurisdiction.


13. Amendments

We reserve the right to amend these Terms at any time without prior notice. Continued use of our website or placing of orders after changes have been posted constitutes acceptance of the revised Terms.
